3. Eligibility to order

By placing an order, you confirm that:

We reserve the right to refuse or cancel an order where we reasonably suspect fraud, misuse, unauthorised resale or a breach of these terms.

Product packaging, labelling or presentation may occasionally change. Images are provided for illustration, and colours may appear slightly different depending on your device or screen settings.

Customers who wear hair extensions should follow the care instructions provided by their extension manufacturer or professional stylist. A product should only be treated as suitable for extensions where this is expressly stated.

5. Availability

All products are subject to availability.

Adding an item to your basket does not reserve it. If a product becomes unavailable after you place an order, we will contact you and refund the affected item.

We may limit the quantity of products that can be purchased in a single order where reasonably necessary to protect stock availability or prevent unauthorised resale.

6. Prices and VAT

Prices are displayed in pounds sterling and include UK VAT where applicable.

Delivery charges are shown separately during checkout and before you confirm payment.

We may change prices at any time, but changes will not affect orders already accepted.

If a product is listed at an obviously incorrect price, we may cancel the affected order and issue a full refund. Where practical, we will contact you and offer the opportunity to reorder at the correct price.

UK online sellers must clearly provide the total price, including taxes, along with delivery options and costs before an order is placed.

7. Promotions and discount codes

Promotions and discount codes are subject to their stated terms, availability and expiry dates.

Unless expressly stated:

  • Only one discount code may be used per order
  • Discounts cannot be exchanged for cash
  • Discounts cannot be applied retrospectively
  • Promotional products and gifts are subject to availability
  • Discount codes may exclude certain products, sets or offers

We may withdraw or amend a promotion where reasonably necessary, but this will not affect an order already accepted.

8. Placing an order

Your order is an offer to purchase products from us.

After placing an order, you will receive an automated acknowledgement. This confirms that we have received your order but does not necessarily mean it has been accepted.

A contract is formed when we confirm that your order has been accepted or dispatched.

We may decline or cancel an order before dispatch because of:

  • Incorrect pricing or product information
  • Suspected fraud or unauthorised activity
  • Delivery restrictions

Where payment has already been taken for a cancelled order, we will issue a refund.

9. Payment

Payment must be made using one of the payment methods offered during checkout.

You confirm that you are authorised to use the chosen payment method and that the billing information supplied is accurate.

Payment providers may carry out security and verification checks. We are not responsible for delays caused by a bank or payment provider conducting legitimate checks.

10. Delivery

We currently deliver to eligible addresses within the United Kingdom.

Delivery options, prices and estimated timings are explained in our Shipping Policy and displayed during checkout.

Delivery dates are estimates rather than guarantees unless we expressly agree otherwise. We will take reasonable steps to dispatch and deliver orders within the stated timeframe.

Responsibility for the products passes to you when they are delivered to you, a person nominated by you or a safe place authorised by you.

Customers are responsible for providing an accurate and complete delivery address.

Unless another timeframe has been agreed, distance-selling rules generally require goods to be delivered within 30 days.

11. Cancellation, returns and refunds

Your rights to cancel an order, return eligible products and receive a refund are explained in our Returns and Refund Policy.

Online customers generally have 14 days after receiving goods to notify the retailer that they wish to cancel, followed by a further 14 days to return eligible goods. Separate rights apply where products are faulty, damaged, incorrect or not as described.

Products sealed for health-protection or hygiene reasons may not be eligible for a change-of-mind return once the seal has been broken. This does not affect your rights where a product is faulty, damaged, incorrect or not as described.

12. Faulty or damaged products

Products must be:

  • As described
  • Of satisfactory quality
  • Fit for their intended purpose

Please contact us promptly if you believe a product is faulty, damaged, incorrect or not as described.

Nothing in these terms limits the rights and remedies available to you under applicable consumer law.

13. Complimentary products and promotional gifts

Where an order includes a complimentary product or promotional gift, that item forms part of the qualifying promotion.

If the qualifying products are returned in full, the complimentary item must also be returned unused and in an appropriate condition.

Where a complimentary item is not returned, we may deduct its stated retail value from any discretionary refund, where legally permitted and clearly disclosed as part of the promotion.

14. Reviews and customer content

Customers may be invited to submit reviews, photographs, videos or other content about their experience.

By submitting content, you confirm that:

  • It is genuine and based on your own experience
  • It is accurate to the best of your knowledge
  • You have permission to share it
  • It does not infringe another person’s rights
  • It is not unlawful, abusive, discriminatory, misleading or defamatory

You grant us a non-exclusive, worldwide and royalty-free licence to display, reproduce and use submitted content in connection with Malibu C UK marketing and communications, subject to applicable privacy laws.

We may moderate or remove content that breaches these terms. Incentivised reviews must be genuine and clearly identified where required.

Businesses publishing reviews are responsible for taking reasonable steps to prevent and remove fake, concealed incentivised or misleading reviews.

Malibu C names, trademarks, product names, logos and brand assets remain the property of their respective owners and are used with permission or authority.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses where products were purchased wholly for commercial purposes.

Consumer contract terms must not unfairly remove or limit liability where the business is at fault or interfere with statutory rights.

18. Events outside our reasonable control

We are not responsible for delays or failures caused by circumstances outside our reasonable control, such as courier disruption, severe weather, industrial action, transport disruption, system outages or government action.
